Permission is granted to electronically copy and print hard copy portions of this site for the sole purpose of placing an order with Bed Arena or purchasing Bed Arena products. You may display and, subject to any expressly stated restrictions or limitations relating to specific material, download or print portions of the material from the different areas of the site solely for your own non-commercial use, or to place an order with Bed Arena or to purchase Bed Arena products. Any other use, including but not limited to the reproduction, distribution, display or transmission of the content of this site is strictly prohibited, unless authorised by Bed Arena in writing. Bed Arena does not represent or warrant that the functions contained in the site will be uninterrupted or error-free, that the defects will be corrected, or that this site or the server that makes the site available are free of viruses or other harmful components. Bed Arena does not make any guarantees or representations regarding the use of the materials in this site in terms of their correctness, accuracy, adequacy, usefulness, timeliness, reliability or otherwise. Some states do not permit limitations or exclusions on warranties, so the above limitations may not apply to you.

Limitation of Liability

Bed Arena shall not be liable for any special or consequential damages that result from the use of, or the inability to use, the materials on this site or the performance of the products, even if Bed Arena has been advised of the possibility of such damages. Applicable law may not allow the limitation of exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you.

Typographical Errors

In the event that a Bed Arena product is mistakenly listed at an incorrect price, Bed Arena reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. Bed Arena reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, Bed Arena shall issue a credit to your credit card account in the amount of the incorrect price.

Termination

These terms and conditions are applicable to you upon your accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by Bed Arena without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.

Use of Site

Harassment in any manner or form on the site, including via email, chat, or by use of obscene or abusive language, is strictly forbidden. Impersonation of others, including a Bed Arena or other licensed employee, host, or representative, as well as other members or visitors on the site is prohibited. You may not upload to, distribute, or otherwise publish through the site any content which is libellous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offence, violate the rights of any party or which may otherwise give rise to liability or violate any law. You may not upload commercial content on the site or use the site to solicit others to join or become members of any other commercial online service or other organisation.

Participation Disclaimer

Bed Arena does not and cannot review all communications and materials posted to or created by users accessing the site, and is not in any manner responsible for the content of these communications and materials. You acknowledge that by providing you with the ability to view and distribute user-generated content on the site, Bed Arena is merely acting as a passive conduit for such distribution and is not undertaking any obligation or liability relating to any contents or activities on the site. However, Bed Arena reserves the right to block or remove communications or materials that it determines to be (a) abusive, defamatory, or obscene, (b) fraudulent, deceptive, or misleading, (c) in violation of a copyright, trademark or; other intellectual property right of another or (d) offensive or otherwise unacceptable to Bed Arena in its sole discretion. Third-Party Links

In an attempt to provide increased value to our visitors, Bed Arena may link to sites operated by third parties. However, even if the third party is affiliated with Bed Arena, Bed Arena has no control over these linked sites, all of which have separate privacy and data collection practices, independent of Bed Arena. These linked sites are only for your convenience and therefore you access them at your own risk. Nonetheless, Bed Arena seeks to protect the integrity of its web site and the links placed upon it and therefore requests any feedback on not only its own site, but for sites it links to as well (including if a specific link does not work).

Ecommerce

1. General

1.1. These Terms & Conditions apply to all orders placed online, via Facebook and over the telephone. By placing an order with Bed Arena you are accepting to abide by these conditions. Please read them carefully and contact our customer service team if you have any questions.

1.2. If you do not wish to comply with these Terms & Conditions, you should not place an order and enter into a contract with Bed Arena.

1.3. Please note that these Terms & Conditions do not affect your statutory rights.

2. Orders and Contracts

2.1. By placing an order through our site, you warrant that you are legally capable of entering into binding contracts.

2.2. All orders are subject to acceptance. All details supplied to Bed Arena must be true and accurate. If we accept the order, we enter into a contract with you.

2.3. If there are any problems with your order we aim to contact you as soon as possible.

2.4. All images displayed are indications of the product; some items may have small variations in ticking and colour, usually as a result of different screen resolutions.

2.5. If you have difficulty placing an order, please contact our sales team who will assist you.

2.6. If ordering a bespoke product from our “Build Your Bed” tool, please be aware that the Cancellation Policy will be different to that of our normal cancellation policy. For further information please read section 10.14 of the Terms & Conditions.

2.7. Before placing your order, please check that the flat packed product will fit through all relevant doorways, hallways and staircases. As well as the fully assembled product fits in the desired location. We recommend that you measure dimensions and if you are unsure, please speak to our Customer Service Team for package dimensions. Bed Arena is not responsible for products not being able to fit in the recipients home, if dimensions have not be obtained or have been mismeasured.

3. Errors

3.1. In the event that any product is displayed with an inaccurate price we have the right to withdraw and cancel the order prior to a contract being made (please see Section 2 for order contract information).

3.2. If there are any errors in the product information displayed on our website, they will be rectified as soon as possible.

4. Price and Payment

4.1. Prices displayed on our website are inclusive of VAT. The price you see displayed is the price you pay. The shipping charges, if such exist, are mentioned in our Delivery policy and displayed at checkout.

4.2. We do not offer any VAT returns or VAT refunds.

4.3. The total price payable for all items ordered and the delivery charge (if any) will be debited from the bank account provided by you when you place the order. If we don’t accept the order (see Section 2 for order contract information), we will refund you the total amount you paid.

4.4. We can only accept payments from UK-registered bank accounts.

4.5. We accept most major credit/debit cards (Visa (including Visa Electron and Visa Debit), MasterCard, Maestro) and payments made through PayPal.

4.6. When you are paying by card, all billing information given must match that held by the bank that has issued this card. Failure to supply the correct information may lead to a delay or cancellation of your order. Your order will be processed once the payment has been authorised and we have accepted the order (see Section 2 for order contract information).

4.7.a. If purchasing through the Facebook platform, a £30 deposit may be required, before order confirmation.

4.7.b. If you request to cancel your order the £30 deposit is not redeemable, unless the cancellation was made in writing within 24hrs of placing the order and paying the deposit. For Bespoke (Build Your Bed) orders, there is a different Policy, for further information, please see Section 10.14 of the Terms & Conditions.

5. Goods Availability

5.1. All products and services are subject to availability and may be withdrawn at any time.

5.2. Any goods that we are unable to supply will be refunded in full or the money can be used for an alternative product on our website.

5.3. Any items that are not in stock have extended delivery dates which are estimated. These products can still be purchased but please note that we will aim to deliver them on the delivery date which you choose from the available dates at checkout (these dates will reflect the longer time needed for the product to come back in stock). In the unlikely event that the product takes longer than expected to come back in stock, we will aim to notify you as soon as we become aware of that. We will do our best to deliver the product(s) to you within the estimated delivery dates but this is not guaranteed.

5.4. In regards to being notified when a product is back in stock, we will only use the email address we collect for the stock notification to send you a stock notification. The email address will then be deleted from our stock notification system.

6. Deliveries

6.1. Delivery days and time – We offer working day delivery (Monday – Friday) delivery on all orders. Saturday and Sunday deliveries are available.

6.2. All standard deliveries may take place anytime of the day, with a one-man service, to the first accessible front door on the ground floor of the property. The delivery is to this door of the property, unless otherwise confirmed by Bed Arena in writing. The driver does not have to take items up steps to get to this door and does not have to take any items into your property. Taking items into the property by the driver is not covered by the courier insurance. If the driver assists you with that, it is solely at their discretion and at your own risk. Please note that we at Bed Arena have no control of when the couriers will arrive.

6.3. On most of our items, we also offer a two-man (room of choice) delivery service which will take the item(s) to the room of your choice, yet only if there is a clear access route to the room. If a lift is not available, the driver will only deliver up to the second floor. Where such a service is available, you will see it in the Delivery Selector at checkout.

6.4. If you have any special delivery requirements, please inform us prior to placing your order so that we can advise if we will be able to meet them.

6.5. With larger items the driver may require some assistance to offload the items, if there is only one delivery driver.

6.6. In the dispatch notification sent to you when we dispatch your order you will receive the contact details of the assigned courier company, and, if this company offers online tracking, some information on how to track your order online.

6.7. Please note that the driver may call before turning up for delivery but this cannot be guaranteed.

6.8. Please check your products (including the packaging and all parts) carefully upon delivery. If a product is damaged or incorrect, please refuse it, sign for it on the delivery sheet as ‘damaged’ or ‘wrong item sent’ and send it back with the driver. Inform our customer service team within 24 hours of the delivery attempt. If you don’t refuse the product and don’t sign for it as ‘damaged’ or ‘wrong item sent’, we are not responsible for any subsequent requests or claims.

6.9. If any boxes are missing from the delivery then please record with the courier how many are missing, accept the boxes that are present and then contact us via email or phone within 24 hours stating which ones are missing. Once we have confirmed which items are missing we will arrange to have them sent to you as soon as possible.

6.10. If there are parts or pieces missing in the boxes you have accepted then give us a call or email us within 14 days and we will send the parts to you with no extra charge. When you contact us, state to us the part numbers of the exact pieces missing (you will find these part numbers in the assembly manual sent with the product) so we can deliver the parts that you want very quickly. If you notify us outside of the 14 days, charges will apply for the replacement of missing parts. If replacing a part will not suffice and you find your goods to be faulty, damaged or incorrect then please refuse the items, sign for them as ‘damaged’ or ‘wrong item sent’ with the driver and contact Customer Services within 24 hours. If you have already accepted the boxes and find parts to be missing or damaged then you will need to contact us via email with accompanying photos showcasing how the parts are damaged.

6.11. Please note that in most cases your product(s) will be delivered on the date which you select at checkout.

6.12. In rare circumstances beyond our control the delivery may take place on a date different than the one you chose at checkout. In this case, we will inform you immediately and arrange the quickest delivery date possible. In this respect, the delivery dates are not guaranteed or promised.

6.13. If you have any special delivery date and time requirements, please inform us prior to placing your order so that we can advise if we will be able to meet them.

6.14. Bed Arena are not responsible for any loss of earnings etc. on the occasions when you were waiting for your order but we will always do our best to get your goods to you as soon as possible.

6.15.a. Bed Arena advise that existing bed frames are not dismantled or disposed of until all deliveries have been checked and all parts are present to be able to build the bed frame.

6.15.b. Delivery destinations – We deliver throughout the UK with the exception of certain postcode areas, see our Delivery information page for details.

6.16. Please ensure that your property is directly accessible to a delivery vehicle which is approximately the size of a 7.5 tonne vehicle. If you require a smaller vehicle for delivery, we can arrange it but you must let us know as soon as you place your order. If there is no direct access for the delivery drivers, or the access is restricted for parking, the delivery may not be made and you wouldn’t be refunded the delivery charges (if such were paid) and may be charged a return fee.

6.17. Bed Arena are not responsible for any losses arising from incomplete or damaged deliveries, or for any losses or damages caused by the courier companies and their drivers.

6.18. Orders may be split and delivered on different days or times due to the nature of the products and their stock.

7. Failed Delivery Attempts

7.1. Please do not dispose of your existing items which you wish to replace with our products and keep them in fit-for-purpose condition. You can dispose of them once you have received, checked and assembled your new product(s) and you are fully satisfied with them. There are rare occasions when we may not be able to make the delivery on the advised date.

7.2. Although at Bed Arena we always strive to deliver within the advised dates and times, we do occasionally come up against problems that can make this impossible. In the event that we are unable to make the delivery on the advised date, we will contact you as soon as possible to inform you and make alternative arrangements. Please be aware that when we use third-party courier companies we are not always able to control the delivery process and have to rely on the information that we are given by them. Please be patient and we will do our best to assist you.

7.3. If you have supplied incorrect delivery details, we will do our best to get your items to you as soon as possible (once we have the correct information). This may cause delays to the delivery and incur additional charges.

7.4. You don’t have to accept the delivery in person. Anybody can take the delivery on your behalf as long as they accept liability for checking that there are no missing, wrong of damaged items sent and for accepting the delivery.

7.5. If no one can take the delivery on your behalf on the advised date, please contact us as soon as possible so that we can make further arrangements. It may be possible that the courier company leave the item(s) at a safe location in your premises (a garage, a shed, etc.) or with one of your neighbours. Please note that if you do choose to leave a delivery at a ‘safe location’ or with one of your neighbours then you do so at your own risk and Bed Arena cannot assume responsibility in the event of missing boxes or damaged pieces.

7.6. If you miss the delivery, please contact us as soon as possible so that we can arrange another delivery date for you. If we have specifically agreed with you the delivery date, on which you miss the delivery, there may be a charge for us to redeliver.

7.7. Please note that we are not responsible for any losses arising from late or failed deliveries.

7.8. Orders will be placed on hold when delivery fails. If delivery is not rebooked, the order will be cancelled, and the return to sender fee will apply, as per cancellation.

8. Risk

8.1. We recommend that there is a responsible adult to take delivery of any goods, check them and sign for them. If you require the goods to be left without a signature, Bed Arena will not be held responsible for any theft or weather damage of your goods. The goods will be left at your own risk. We do not recommend that your goods are left outside, due to danger of weather damage or theft.

8.2. Once delivery has been made it is the customer’s responsibility to take reasonable care of the items.

9. Faulty Items

9.1. Should a fault develop with your item we will deal with your complaint in accordance with our Manufacturer's Guarantee Terms & Conditions and in conformity with your rights under the Consumer Rights Act 2015.  All suspected manufacturing faults should be reported to us in writing within 30 days from the date of delivery. If the product is covered by our Manufacturer's Guarantee, we will arrange to send you a replacement of the damaged part(s) or at our sole discretion a full replacement may be sent. The option to receive a refund for the price of the faulty product may be applicable, dependent on our Manufacturer's Guarantee. For further details please see our Manufacturer's Guarantee.

9.2. If the product is covered by our Manufacturer's Guarantee, a five years guarantee applies to products purchased on or after 1 July 2016. Products purchased before 1 July 2016 are subject to a one year Manufacturer's Guarantee.

9.3. In regards to replacing spare parts, the customer is responsible for disposing of any faulty parts (unless otherwise stated).

10. Returns, Refunds and Cancellations

10.1. Please check your products (including the packaging and all parts) carefully upon delivery. If a product is damaged or incorrect, please refuse it, sign for it on the delivery sheet as ‘damaged’ or ‘wrong item sent’ and send it back with the driver. Inform the Customer Service team within 24 hours of the delivery attempt. If you don’t refuse the product and don’t sign for it as ‘damaged’ or ‘wrong item sent’, we are not responsible for any subsequent requests or claims.

10.2. If you ordered the wrong product, decided that you don't want the product any longer, or are not satisfied with your product for any reason (excluding manufacturing faults; for manufacturing faults see Section 11), report this in writing within 15 days from the date of delivery, and ensure that we receive the product back within 15 days from the date we authorised the return, you will be given the option to return the product to us for a refund or an exchange. These products must be unopened, in their original packaging and must not have been assembled. Products also should not have been used to be eligible for return without manufacturing faults. You must ensure that the products are undamaged. If these time frames are not kept, we are not responsible for any return requests. If wishing to return a rolled (vacuum packed) mattress, please contact us before doing this as there are specific requirements for the packaging. If these requirements are not followed, a refund will not be authorised.

10.3. It is your responsibility to make sure that the product (including all boxes with parts, if applicable) will fit all stairs, passages, doors, etc. until it reaches the room where you will keep it. Also make sure there will be enough space for the (assembled) product to fit in that room. Check this Measuring Guide and the dimensions on the product pages for more information. If the product doesn't fit, we are not responsible for any return requests and claims. You should call our customer services team if any information isn't listed.

10.4. You are responsible for returning the products to us. To return the products first get in contact with us to clarify any details. After which you can either use your own courier or we can arrange for a courier to collect the products from you and return them to us at your cost. This is dependent on your area and the product in question, however quotes can be advised through our customer services department.

10.5. Prior to returning any goods you must inform the customer service team in writing within 15 days from the date of delivery. A phone call will not suffice.

10.6. For our return address please call us prior to arranging the return of the products. We will then provide the most appropriate address.

10.7. If you use your own courier, please provide us with return tracking details and ensure that a document is sent together with the product with the order number, your name and address, product name and signature. Our warehouse is open for returns Monday - Friday 9 am – 12 pm and 2 pm - 4 pm (excluding Bank Holidays) and the driver must call us 2 hours prior to arrival. Please note that no deliveries into Bed Arena can be accepted at any other time. Bed Arena is not responsible for failed deliveries made outside of this time or losses/damages made by your courier. It is your responsibility that the products are returned to us in undamaged condition; if they are not in such a condition, we will not accept the return. Return paperwork will be provided and all goods must be signed for.

10.8. Once we have received the goods we will inform you and arrange a refund or an exchange (depending on the agreements we have made with you). In case of an exchange for another product, the price difference between the initial and the new product (if any) has to be paid by you before we arrange the exchange with the courier (if the new product you require is more expensive than the initial one) or refunded by us to you (if the new product is cheaper than the initial product). Please note that the exchanged product will adhere to the price it was at the time of purchase, while the product it’s being exchanged for will adhere to the price it is at the time of the exchange.

10.9. If you are unable to arrange your own carriage of the product you wish to return we may be able to arrange it on your behalf with one of our couriers. You are welcome to contact us to see how we may be able to help and assist you. Collections from customers are available Monday - Friday and are an all-day service 8 am - 6 pm. The drivers are not guaranteed to call before collection and we cannot provide a narrower time window. The charge for collection will vary depending on your location and the size of the item. Please ask a member of our customer service team for the associated costs. Bed Arena are not responsible for failed or delayed collections.

10.10. If you require us to arrange the collection of product(s) to be returned with our courier, we will take the payment for the collection first and then we will refund you for the price of the product(s) (these costs will all be agreed before deciding if you want to return your goods).

10.11. The item(s) to be returned should be in their original packaging and ready to be collected from first accessible front door on the ground floor of the property, as the delivery services will not collect from any other floor.

10.12. Refunds – A refund will be issued only after the product is received in our warehouse undamaged. Please note that it can take 14 working days for your refund to be processed, depending on when it returns to Bed Arena. If the return or cancellation request has not resulted from one of our courier’s mistake regarding the order, the original shipping charges paid as part of the order (if any) are not refundable.

10.13. Cancellations – You can cancel your order free of charge if you request the cancellation in writing before we have dispatched it. Orders cancelled after Bed Arena have dispatched the product(s) will be considered as a return. See above for the possible charges.

10.14. Bespoke Product Cancellations – You can cancel your order if you request the cancellation in writing (not by telephone) before we have dispatched it. However, if the cancellation request occurs once the product has been manufactured but has not been dispatched, there will be a restocking fee, which could be a percentage of the product price. Orders cancelled after Bed Arena have dispatched the product(s) will be considered as a return. See above for the possible charges.

10.15. All time frames and other Terms & Conditions mentioned in Section 10 are in accordance with the Consumer Rights Act 2015.

10.16. Goods that arrive flat packed cannot be returned via collection without the original packaging. Goods will only be collected in the same flat-packed condition in which they were delivered.

11. Mattress Quality After Delivery

11.1. All mattresses usually take up to 6 - 8 weeks approximately to settle to their specified tension, as they take time to contour to each sleeper’s body.

11.2. The one-sided mattresses need to be rotated (so the head end becomes the foot end and vise versa) every week during the first 6 weeks, thereafter every 6 weeks.

11.3. The zonal support two-sided mattresses need to be flipped over (so the sleeping surface is changed) every week during the first 6 weeks, thereafter every 6 weeks. The other two-sided mattresses need to be flipped and rotated every week during the first 6 weeks, thereafter every 6 weeks.

11.4. All mattress tensions are based on an individual weighing approximately 12 stones (75 kg). On our product pages you will find a handy tool where you can select your weight and you will see the feeling of firmness you would have if you sleep on the respective mattress (a mattress normally feels softer for heavier people and firmer for lighter people). Please note that each person’s perception of mattress firmness is different so our advertised firmness rating must be taken only as guidance.

11.5. The natural fillings and the foam in some of the mattresses may give out an odour for the initial 6 weeks. When your mattress is delivered, you should let it air in a well-ventilated room until the smell subsides.

11.6. When opening a vacuum packed mattress, please allow 4 hours for its initial expansion. The mattress is okay to use after this period however it will continue to expand (to a lesser degree) over the following 72 hours. Any odours from the packaging will be eliminated in the process.
